Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using the "Easy Cals" mobile application (the "App"), you agree to be bound by these Terms and Conditions. The App is owned and operated by SOFTPRIME SOLUTIONS CONCEPT S.R.L. ("Company," "we," "us," or "our"). If you do not agree to these terms, do not use the App.

2. Medical and Health Disclaimer

Easy Cals is a calorie and macro tracking tool designed for informational purposes only. The App does not provide medical advice, diagnosis, or treatment. You acknowledge that:

  • You must consult a qualified healthcare provider before starting any diet, weight loss program, or altering your nutritional intake.
  • Calculations and macro recommendations provided by the App are estimates and should not replace professional medical or nutritional guidance.
  • SOFTPRIME SOLUTIONS CONCEPT S.R.L. is not liable for any physical or mental health issues, injuries, or damages resulting from the use of the App.

3. User Accounts and Eligibility

You must be at least 18 years of age to use Easy Cals. By using the App, you represent and warrant that you meet this age requirement. If you authenticate using third-party services like Apple, you are responsible for maintaining the confidentiality of your credentials. You agree to accept responsibility for all activities that occur under your account.

4. Subscriptions and Payments (iOS)

Easy Cals offers auto-renewing premium subscription plans. By purchasing a subscription, you agree to the following terms, as required by Apple:

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage your subscriptions and turn off auto-renewal by navigating to your Account Settings in the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Cancellations and refunds are handled exclusively by Apple according to their App Store policies.

5. AI Features and Fair Use Policy

Easy Cals utilizes third-party artificial intelligence (AI) providers to enhance user functionality.

  • Accuracy Disclaimer: AI-generated outputs regarding food identification, macro estimation, or general advice may contain errors or inaccuracies. You must verify all critical nutritional information.
  • Fair Use and Throttling: To maintain service stability and manage API costs, we enforce a Fair Use Policy. SOFTPRIME SOLUTIONS CONCEPT S.R.L. reserves the right to throttle, temporarily suspend, or limit your access to AI-powered features within the App at our sole discretion, without prior notice, if we detect excessive usage or system abuse.

6. Third-Party Services and Data

The App integrates with third-party databases, including the USDA FoodData Central (FDC) and Open Food Facts, to provide nutritional data.

  • We do not guarantee the accuracy, completeness, or reliability of nutritional information provided by these third-party databases.
  • By logging in via Apple Authentication, you are also bound by Apple's respective terms of service and privacy policies.

7. User Conduct and Restrictions

While user data currently remains private to your account, you agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or extract the source code of the App.
  • Scrape, extract, or mine data from the App's food and calorie databases.

8. Intellectual Property

All original content, features, code, logos, and UI/UX design within Easy Cals are the exclusive property of SOFTPRIME SOLUTIONS CONCEPT S.R.L. and are protected by international copyright and intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SOFTPRIME SOLUTIONS CONCEPT S.R.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill resulting from your access to or use of (or inability to access or use) the App, its AI features, or third-party nutritional databases.

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Romania, and you hereby consent to the personal jurisdiction and venue therein.

11. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the App following the posting of revised terms means that you accept and agree to the changes.
